Class Action Defense

SITUATION
The manufacturer and distributor of the world’s leading energy shot needed legal representation in a class action lawsuit.

PROBLEM
The company was sued in a class action lawsuit alleging that it had engaged in price discrimination in favor of big box retailers like Costco at the expense of smaller wholesalers.  The plaintiffs sought over $100 million in antitrust damages.

SOLUTION
We engaged in an aggressive defense strategy and worked with a top economic expert to demonstrate that our client’s pricing was fair and not discriminatory. We defeated the plaintiffs’ motion for class certification (showing that our client did not treat small wholesalers differently as a class of purchasers) and proceeded to trial, where we obtained a complete defense victory.

BENEFITS
We turned a $100 million lawsuit into a complete defense victory.  Our client paid nothing to the plaintiffs and suffered no business disruption.
